SALES  PRICES AND PAYMENT METHODS

All sales prices are the final price to the consumer, including italian sales tax.

Sales abroad exclude any and all import duties or supplimentary costs charged by the destination country. NiMAR S.r.l. reserves the right to modify prices in any moment without notification. Once merchandise is ordered, the relative price will be definitively blocked and invoiced accordingly without variation.

NiMAR S.r.l. exclusively accepts payments using paypal, credit card or bank transfer. All shipments must be destined to the official address listed with your payment provider.

WARRANTY AND METHOD OF ASSISTANCE


The 12-month warranty applies to products that present a lack of conformity, provided that the product itself is used correctly, in accordance with its intended use and as set out in the accompanying technical documentation.

Requests for authorization to return merchandise must be accompanied by a copy of the purchase invoice and be sent by e-mail to: assistenza@nimar.it.

Should NiMAR S.r.l. authorize the return of the merchandise, the customer must comply with the shipping instructions as indicated by NiMAR S.r.l..

Customers must pay for the shipment of defective merchandise, while NiMAR S.r.l. shall pay to return the repaired or replaced merchandise to the customer.

PLEASE NOTE:

Unauthorized returns will not be accepted.

The warranty is not valid if the product has been tampered with or altered by unauthorized personnel, if the defects have been caused by negligence or improper use, fraud, transport, jolts or bangs, falls or in any case, use which is not suitable for the destined use of the product, or in any way in contrast to the indications contained in its accompanying manuals.

Following technical verification carried out by NiMAR S.r.l., should the alleged defect not result in a lack of conformity, or should the returned merchandise be fully functional, the customer will be charged for the costs of verification, as well as all the transport costs incurred by NiMAR to return the merchandise to the customer.

The warranty only covers the repair or replacement of unusable or inefficient parts due to manufacturer defects, found by authorized NiMAR S.r.l. service center personnel.

In case of ascertained lack of conformity, NiMAR S.r.l. will, at its sole discretion, restore the merchandise by repairing or replacing it with new merchandise.

The timing of replacement or repair of the merchandise depends exclusively on the policies of NiMAR S.r.l..

If the repair of the merchandise does not fall under warranty, NiMAR S.r.l. shall notify the customer of the cost to repair the merchandise, before proceeding with the intervention, awaiting the express authorization to do so.

NiMAR S.r.l. shall never, in any case, be responsible for damages deriving from any interruptions in the operation of the merchandise subject to warranty.

THE CUSTOMER'S RIGHT TO WITHDRAWL

NiMAR offers a 5-day return policy for new merchandise purchased directly through our online store.

Essential terms and conditions for the exercise of the right to withdrawal by the customer:

The right must be exercised within 5 days from the date of receipt of the merchandise.

The request must be communicated by email with the attached copy of the purchase invoice to: assistenza@nimar.it

NiMAR S.r.l. will then communicate the shipping instructions which must be respected.

The return of the merchandise must take place within 5 days of receipt of  NiMAR S.r.l.'s confirmation to proceed.

The shipping costs to return the merchandise to NiMAR S.r.l. are entirely borne by the customer.

The returned merchandise must be in its original condition and must be carefully packaged so as to safeguard the original wrapping, writing or labels against any damage.

NiMAR S.r.l. will charge a commission of 15% of the purchase value.
This commission covers the administrative costs for the management of the return, as well as the inspection and testing of the equipment.

Once the merchandise is received and its integrity is verified, NiMAR S.r.l. will credit the customer with the amount paid less the deducted charges described above.

Finally, if the merchandise proves not to correspond to the original condition, NiMAR will charge the customer for the verification costs, as well as the transport costs to return the merchandise.

JURISDICTION

Any dispute concerning the application, execution, interpretation or violation of online trading agreements through the use of the www.nimarwaterhousings.com website is subject to Italian jurisdiction.

Any dispute between the parties regarding this contract as specified above, the court of residence of the customer or elective domicile of the final consumer will be competent, in all other cases the jurisdiction of the Court of Modena (MO) Italy will be exclusive.

The Italian language version of this warranty shall prevail.
